Waiver Agreement
Motorcycle Rental Terms and Conditions
The following outlines how rentals and tours work at Colombia Motorcycle Rental & Tour Co. (SG Enterprises Co SAS). By renting a motorcycle or joining a tour, our clients acknowledge and agree to the following terms:
1. Responsibility for Motorcycle and Equipment
Clients must return motorcycles and gear (helmets, luggage, etc.) in the same condition as received, excluding normal wear. You're fully responsible for any damage, theft, or loss during your rental—whether caused by you or someone else.
2. Use of Motorcycle
Only the main renter can operate the motorcycle. Usage must follow these rules:
- No breaking local laws
- No riding under the influence of drugs or alcohol
- For safety purposes, all routes need to be approved in writing via WhatsApp
- No riding at night unless approved in writing via WhatsApp
- No overloading motorcycles beyond the manufacturer’s recommendations
- No false ID or payment info
3. Security Deposit
A security deposit (amount specified in your rental agreement) is required. This covers potential damage or costs. If everything checks out and the bike’s returned with a full tank, we’ll refund the deposit within 7–10 days.
4. Collision Damage Waiver (CDW)
We currently do not provide collision and damage liability insurance, you’re fully responsible for all damages.
5. Loss of Use
If your rental ends up out of commission due to damage, you’ll be responsible for lost rental time—up to 90% of the daily rate—until it’s fixed, capped at the full replacement value.
6. Repairs and Mechanical Issues
Let us know immediately if anything mechanical comes up. Unauthorized repairs won’t be reimbursed. Flat tires, towing, and regular wear repairs and maintenance are your responsibility.
7. Insurance and Liability
Colombia’s basic SOAT insurance offers limited medical/liability coverage. We highly recommend additional international or vehicle insurance. It’s your job to know what you’re covered for.
8. Traffic Violations and Fines
You’re responsible for all fines or tickets during your rental. Common issues include:
- Speeding
- Running red lights
- Parking violations
- Not wearing helmets or reflective vests
- Driving in restricted zones or during "pico y placa" hours
Traffic violations typically range from $150–$300 USD.
9. Termination of Rental
We reserve the right to cancel your rental without refund if you break the rules or behave recklessly.
10. Damage Assessment & Repair Costs
We’ll inspect the bike and gear when you return it. If we find damage, these standard charges apply:
- Mirror: $50 each
- Brake Levers: $25 each
- Handlebar Mounts: $100
- Clutch Levers: $25 each
- Handlebars: $250
- Indicators: $100 each
- Hand Grips: $50 each
- Scratched Plastics: $50
- Broken Plastic (per area): $200
- Headlight Cover: $200
- Side Tank Cover: $500
- Helmet: $300
- Gloves: $25
- USB/Phone Mount & Charger: $100
- Luggage & Rack: $250
- Crash Bars / Protection: $300
- Chassis Damage: $1,000
- Other: Quote provided within 7 business days
You’ll be billed based on this list, though we may consult a third-party mechanic for complex issues. These prices serve as a guideline and can be adjusted based on actual repair or replacement needs.
